Yes, it will be an exciting story with eaves and ridge heights. Because in this construction, there is no ridge height, as the eaves height results from the eaves of the penthouse (a ridge height cannot be determined for this building).
It's a pity that we no longer have our specialist for this in the forum. He also once said:
"Actually, according to the guiding principle of a ruling by the OVGMV, the eaves of the penthouse counts as the eaves height. But since the ruling refers to a specific case, it also opens up possibilities for interpretation in differently composed cases."
But maybe there is something about it in the development plan.

I hope the development plan was carefully reviewed, because such a project can lead to many problems:
- The mentioned eaves height
- In many new development areas, a green roof is required for flat roofs (if that is the case, also consider the additional costs there)
- Hope 3 apartments are allowed (often limited to 2 residential units)
- Pay attention to the floor area ratio (the terrace also counts, so be careful when choosing the size)
- Sometimes 30% planting of the property is required. This might also be tight here.

According to the mentioned guidelines and the fact that you are not dealing here with anyone who knows the state building code or has knowledge of housing planning, I dare say that this was probably not taken into account and probably will not be the case. You can still fit 3 parking spaces on a 500sqm plot, but nobody wants to live next to 5 parking spaces as a neighbor. That is why new development areas are zoned into multi-family house zones, closed development (terraced houses), and open development (semi-detached + single-family houses) with the option for 2 residential units. But I may be wrong.

Hello Enrico,

thanks for your note. I can manage it at that price. If you negotiate properly, you can achieve worlds. In 2022, I already built a house with 315 sqm including basement. Total production costs, including kitchen and bathroom fittings, about €450k. I live in that house myself and paid attention to very good quality (large tiles, large windows, concealed fittings, more expensive pipes for underfloor heating, etc.)

For each of the trades, I could easily have spent double if I hadn’t looked for other service providers and refrained from frills.

Just for the roof alone, I could have paid €45k instead of €23k, the same goes for plumbing and electrical. For the shell construction, I buy the materials myself and pay the shell builder his wage.

It is a shame that a large part of the discussion revolves around the budget when that is not the issue at all.

You are wrong, here are the specifications from the development plan.


If someone does not want to live next to 5 parking spaces, they have to find another residential area. Everyone building here must be aware that the neighboring house can have 3 apartments and thus 5 parking spaces.
