Hehe, as if Neuwied itself weren't already a small village ;-)
I'm even in the area today, but I don't have time for a detour to Segendorf; maybe I'll at least manage to stop by Block to see if there is any progress on the dream house construction site (another thread here) ...

I do not know the history of the state building code of RP. The first state building code in NRW is from the summer of 1962. Before that, there was no building encumbrance register. Everything that was lawfully constructed up to that point remains valid. The new must, however, comply with the current legal situation. My subjective assessment of your case: Either you build on or you keep the required fire protection distance of 5m. I do not see the 6m distance areas here, as there is obviously no such security through building encumbrance, land register, or agreement. Ultimately, however, it is decided by the building authority according to due discretion.

I consider that not to be approvable.

To a local building submission authorized designer with much experience in building on existing properties.

I think so too.

I have been waiting for 's response. I don't understand the whole discussion. I probably missed something or something. Anyway: where there are windows, you can't just build onto it like that. Fire protection and all ;) The neighbor won't have to lose a window either. Why should they? …, there are enough areas left for an independent construction.

thanks for the info. We are still unsure whether to find an architect and local builder or go with larger corporations

maybe you actually overlooked something :) . The neighbor built his house on the boundary. Normally, you’re apparently not allowed to build windows on such a wall. But in this declaration from the 60s by the neighbor and the former property owner, the neighbor was allowed to build windows that have to be bricked up if someone builds onto our property now.
And well, if it were that simple with the property, we wouldn’t have to ask here how to best solve it.
At first, everyone told us something different. And now we are unsure how to get it done best. We don’t want to take the windows away from the neighbor, but of course we also want to get the best out of our property

Doesn't that mean he has legal protection? You don't have to build there. Your property is neither restricted nor is it otherwise developable. The best for a house is when you can create windows on all sides ;)

I have no idea... Yes of course we would like to have windows on all sides :) But at the beginning we thought it couldn't be helped because of the garage on the left, and we had to build the house up to 4m next to the neighbor's wall. Building the garage to the right of our future house directly against the neighbor's wall (including losing their windows) is just too complicated. Plus, it would cause immediate conflict in the new neighborhood, which we don't want. But with the new considerations about turning the garage and then building the house slightly offset behind it, we could keep the 6m distance to the neighbor's wall. So that's actually a good new idea. I'm curious to see who wants to build with us and when :) we have chosen a relatively difficult time.
