If I have correctly interpreted the parameters, this would only be possible through a Baulast. This involves additional costs; the relevant plans may be prepared by any publicly appointed surveyor or cadastral office in NRW. Architects are expressly _not_ allowed to prepare location plans for Baulast registration.
Another disadvantage: for further/future building applications, the location plans for the building requests (extension, additional garage, carport, etc.) must also be executed by a publicly appointed surveyor/cadastral office as an official site plan. Although this does not always become apparent during the review, the owner can be lucky that an architect's plan is accepted, but this should at least be kept in mind for further construction projects. This applies especially to the neighbor, as the Baulast rests on their property. For the beneficiary property (yours), this is actually also the case, but it tends to be overlooked during the building authority’s review.
However: the neighbor may, for example, build a garage (i.e., a so-called privileged construction project) on the Baulast, meaning that with mutually clever planning, there is no structural disadvantage despite the Baulast registration.
