I'm really trying to be flexible - meanwhile I also spoke with a planner. He also had serious concerns.

The plan requires building two parking spaces per residential unit and an additional one per commercial unit. Parking spaces in front of the garages also do not count as parking spaces according to the development plan, since the garage and the space in front cannot be used simultaneously. Therefore, the third parking space has to be next to the space in front of the garage. I already use that space twice as "path to the house entrance / parking space."

Based on a standard parking space with 2.3 meters width and 6 meters length, that's 41 sqm. The building area also forces the garage not to be built on the property boundary. The plan also does not allow the areas in front of the garage and the parking space to be unpaved.

As I said: a house with 120-140 sqm living space has 10x10 meters, plus the parking spaces/garage and the permitted footprint is used up or exceeded.
Of course, you can reduce the terrace - but that doesn't help, since with garage, parking space, and house the floor area ratio is already exceeded.

The municipality said about this: No, that is not the case because it is not indicated that way in the development plan either. I had already been through that...

How come?
At the beginning you say:

"A finished development plan does not exist yet."

The community's statement only makes sense if it already knows that it will deviate from this exception possibility in the future development plan. So the aforementioned sentences 3 and 4 of § 19 IV Federal Land Utilization Ordinance ....

Then everything becomes very small....

This has meanwhile also proven to be incorrect in the conversation with the municipality. The development plan has been final since March 2015 and corresponds to the document I have, which is just not titled "development plan" :(

So you are not just building a single-family house, but a mixed-use property with a commercial unit and a residential unit?
I don’t understand now...
