Thank you , we are indeed caught in a dilemma here. The neighbor started construction this week or rather excavated the pit. Their GÜ is now no longer willing (contrary to his proposal to the neighbors 6 weeks ago) to submit an amendment request for the garage and wants to build the garage as planned in the free-standing design with 3 meters distance from our property. You wrote that he is no longer allowed to build on the 3 meters between his garage and our property boundary (because of 5.1.). Do you mean the fire department access routes? There are other possibilities for that (for example between his garage and house), or am I misunderstanding something? The more I think about it, the more I will probably have to bite the bullet. Completely giving up on the garage hardly seems like an option, so rather a single garage and an unroofed parking space, which could possibly be converted into a carport next year if the easement works out after all…
