Abnormal parking space regulation - legal action or ignore?

Ok, this is really crap. Sorry, if they thought that way, there’s hardly anything that can be done. The question is what “befestigt” means. Maybe compacted gravel is enough, then you can sow gravel lawn on it. The area can still be nicely used for barbecuing, table tennis, or something like that. Officially 2-3 parking spaces, in practice it’s a play and sports area.

Suggestion: try to keep the m2 of living space under 200. Then you only need 4 parking spaces.

A carport would also relax the situation. You can use the spaces in front of the carport as parking spaces. Simply submit the garage without a door. Warning irony: a door will be retrofitted later.

I assume the municipality has also described compensatory payments for missing parking spaces in the statutes. In that case, it must be worth it if someone comes to that. Or you have planned 2 parking spaces for that case in the plan. Execution: grass pavers and done.

The placement is specified in the development plan. In principle, we don’t want that either; we want to use the garage forecourt as parking spaces. Those are actually the most practical parking spaces in reality and for daily use.

Yes, compensation would be basically possible according to the statute. But no amount is specified. From my point of view, that would only be an absolute last resort (waste of money for sensible regulations); I would rather pursue the legal route. Simply marking it in the plan would be unproblematic. It would only be bad if they actually had to be built; that would totally ruin the garden.

You should be able to find a workable solution. As I said, grass pavers are inexpensive and can be used in an emergency. The kids are getting older. Believe me, I know what I'm talking about.

Can you provide us with a link to the [Satzung]?

In the last resort, I would actually file a lawsuit against it. It is simply incomprehensible why a "recognizable" single-family house needs so many parking spaces. If your floor plan naturally looks like a house with 2 apartments, I would assess it differently.

It is a pure single-family house, without a granny flat or something similar.

Would you go directly the legal route or first mark "dummy parking spaces" and only take the legal route if the construction is demanded?
