With bay window into the setback areas - permitted in this case?

I think the [Bebauungsplan] is unclear in some points. That can only cause trouble... So now the question is even whether I will get approval for the 5-meter-wide bay window at the back.

The head of the building department referred to the state building code for all my questions regarding bay windows in the setback area to the neighbor.

It is also not explicitly stated in the development plan that it is not allowed. The development plan deals with exceeding the building boundaries to the back and front. Nowhere is it mentioned that 3m or 2.5m to the neighbor must be maintained.

It all seems very much like a matter of interpretation to me.

If it can comfort you: this applies to all BV nationwide. I have often been given different "guidelines" when a head in the building authority, the caseworker, has changed. I have given up trying to always understand it

Find yourself a capable architect/salesperson and he/she will get the best out for you

That probably only seems that way to you because, as a layperson, you have no basic knowledge in architecture and construction science.

Why do the interpretations of people with basic knowledge contradict each other?

Some here say the bay window must not extend towards the neighbor because it is not mentioned in the development plan - however, the head of the building authority refers to the state building code where it is allowed.
You interpret the 1/3 bay window rule as valid within the building envelope - my architect is planning a larger bay window towards the garden within the building envelope.
You interpret the 1/3 bay window rule as applicable to the sum of all bay windows around the house - my architect is planning another bay window on the front side, also wider than 1/3 and also within the building envelope.

5 pages of expert opinions and I am basically as wise as before. Even the fact that I should best get the opinion of (another) architect I had expected beforehand.

Sorry, but clarity means something different to me.
