With bay window into the setback areas - permitted in this case?

If this is provided for in the development plan, you are also allowed to do that.


If it is that simple, why - do you think - is a development plan then specified?

First of all, what is stated in the development plan applies. If it specifies that you must maintain the usual 3.00 m distance to the neighbor, you must comply with that; no matter what is in the State Building Code.

However, I do not understand the problem either. Why don’t you reduce the size of your garage? Reduce the garage to 3.50 m in width and then no building encumbrance is needed any more.


That cannot be explained in detail in a forum; moreover, the information from the development plan is missing.

Originally, a basement and a 4m wide garage were planned. The basement is omitted, so I am trying to get more space on the ground floor for technology and storage without pushing the house into the garden. So I would actually like to make the garage bigger. Unfortunately, it already sits at the building boundary at the back.

The development plan does not specify how large the distance to the neighbor must be. It also does not say how far the distance can be reduced with bay windows. I just thought that everything not mentioned is covered by the state building code.

In my opinion, that also doesn't work going forward because the boundary distance and crossing the building line are two different and independent things. The boundary distance may be maintained, but crossing the building line still needs to be separately secured.

But as I said, this can probably be managed with slight corrections and in cooperation with the architect/publicly appointed surveyor. Whether the additional costs are worth it is then a personal decision.

I just read the part about distance areas in the state building code BW; I can understand that the original poster believes they will get this approved that way. The information from the development plan—that the garage must remain within the buildable areas of the property—is also not very helpful in this regard


I would also recommend that.
