Tenant does not want to pay the rental deposit - damage is time-barred

Today I can pick up the enforceable title from the lawyer and use it to pay out my rental deposit account... I then asked the lawyer how to proceed in the case. His answer: "I don't know what you will do with the money then".... of course, I didn't mean that, but referred to the further outstanding costs that are still due to us as well:

Attorney fees 440 euros,
Court costs 160 euros,
Interest 150 euros...

Another treat: "Your main interest is satisfied for now... We'll have to see about the rest". Yes, I got my rental deposit of nearly 900 euros back... the 750 euros "secondary interest" are of course irrelevant to me... or what is that supposed to mean and what am I supposed to see? According to the court, these are also due to me.

I will never consult this lawyer again. Makes lots of mistakes, then acts all high and mighty and makes such stupid comments.

The bomb will drop when, despite success, we have to cover court costs... just because of his incompetence. But I will not put up with that.

I have also enforced my position and got the right...so I did everything right, didn’t I? I will get the costs reimbursed by the landlord. That is stated in black and white in the court ruling. But the lawyer lets months go by without taking any action. When I then ask him why nothing has happened for months, I get answers like:

1. I thought he would now voluntarily release the rental deposit account.
2. Their main interest is for now satisfied... We will have to see about the rest – all that takes time.

Basically: I don’t really feel like doing anything. If you didn’t call (annoy) now and then, the file would already be in the trash.

The bailiff initially only costs a two-digit amount. Since the debtor owns a property, and thus has seizable assets, one should be able to get the money in the long (!) run. I exclude the debtor’s insolvency. However, given the background, it wouldn’t really surprise me anymore. As I said, I’ll keep my fingers crossed. Thanks for keeping us updated.
