For me, this is a liability claim against the lawyer... I have demonstrably pointed this out to him before sending the complaint... and then once again afterwards... let's see what the court's exact billing will bring now.

You don't care whether the lawyer reports this to his liability insurance: Primarily, HE is liable to you in this case - meaning he has to cover these costs. If he is really a "lawyer," as he is supposed to be, then he will take responsibility for it.

He just said it’s due to this error... but actually it’s the court’s fault, since they should never have arranged the cost allocation that way. He now wants to write a complaint to the court... but that’s only possible from 600 euros onward. So for now, he is passing the blame away from himself.

Purely from common sense, you are off the hook - the lawyer has to take care of it himself, he messed up. If he now thinks that the court made the mistake, he can see how they fix it. Since in matters of law it unfortunately doesn’t always go by common sense, the matter will probably be tricky. Actually, the lawyer should take the blame - but he probably has a dozen paragraphs at hand that keep it your problem. I can’t give you any helpful advice, but I’m keeping my fingers crossed that the problem will be resolved and you won’t have any costs!

Today I can pick up the enforceable title from the lawyer and have my rental deposit account paid out... I then asked the lawyer how to proceed in this case. His answer: "I don't know what you'll do with the money then".... of course, I didn't mean that, but referred to the further outstanding costs that are also due to us:

Attorney's fees 440 euros,
Court costs 160 euros,
Interest 150 euros...

Another gem: "Your main interest is satisfied for now... We'll have to see about the rest." Yes, I got my rental deposit of almost 900 euros back... the 750 euros "secondary interest" don't matter to me, of course... or what is that supposed to mean and what am I supposed to see there..? According to the court, these are also due to me.

I will never consult this lawyer again. Makes a lot of mistakes, then acts all high and mighty and drops such stupid comments.

The bomb will explode when, despite success, we have to pay court costs... just because of his incompetence. But I won't put up with that.
