Only belief allowed, solutions?

Good evening,

we are shortly before the building application. The floor plan and everything else is ready. We only have one problem. We have a knee wall of 1.55 m and in the development plan [BB-Plan] there is a regulation that only dormers are allowed and they must not break through the eaves. For the exact wording, I have attached the development plan. Due to the relatively high knee wall, we now have the problem that the windows in the dormer do not start at a "normal" height. We are building with a solid construction company and the seller incorrectly entered the parapet height (1.20 m) instead of 1.55 m, which is why I only noticed the problem very late. (Yes, I know, I messed up and didn't think far enough that the parapet height cannot be 1.20 m with that knee wall. :( )

The architect says there is no chance to build a gable or with a lower parapet height, but I don't necessarily feel that he is fully committed. I was told by someone that they solved the problem by including a balcony in the building application drawn in the dormer, which they then left out and so still had a gable. However, I can't quite understand that yet, because with the balcony the eaves would be interrupted.

I now hope that some keen users are reading along here and might have another idea. The fact is: from a window with a parapet height of 1.55 m, I can only look out standing on my tiptoes.

The simplest solution would be to extend the eaves so far that the dormer no longer goes beyond the eaves?

Yes, I’ve thought that too. But somehow the architect wanted to tell me that it’s not possible. I have to follow up on Monday. So you see it that way too? It’s all getting confusing for me. We currently have a roof overhang of 50cm (measured perpendicular to the house wall) and a knee wall of 1.50m and a roof pitch of 35 degrees. I’ll try to make a drawing.

Better post the house plans (as an image, hosted here!) instead. Sketches from confused laymen lead to nothing. No, the legal eaves share only the name with the real gutter.

If I interpret the measurements correctly, the eaves height is currently at 6.955 m, where 7.50 m would be allowed. I would raise the knee wall by half a meter and reduce the roof pitch from 35° to 30°. Dormers / returns are clearly not allowed by the development plan, and dormer windows (as well as roof windows) are already clearly nonsense at a knee wall height of 150, as you can hopefully see clearly in the picture, even as a layperson.
