Your neighbors do not necessarily have to give their consent to a construction project. However, it does no harm, for example, when deviating from the development plan "such as by not complying with the setback distance of the roof terrace" to obtain the consent of your neighbors. The neighbor can approve the plan by signing, but he does not have to.

With your planned construction project, I would have submitted a building inquiry and asked whether it would be approved in the exemption procedure.

With us, the building authority had a reputation for often rejecting exemption requests (due to minor issues) so that the district office would also be involved. It does make a difference whether it costs 700 or 100 euros. :p

Then they will have an eighty-year-old external rubber stamper, with whom the draftsman is not supposed to start any arguments or even contradict. That's how it is when you build with a draftsman. The neighbor of the roof terrace would be the way. But neighbor approval is only required for exemptions and exemptions only for building applications, not for permits without approval. If the planner does not want to have any discussion with the building authority, he simply does not let the terrace preparation appear at all in the plans here. I do wonder, however, how one even gets to this terrace.

You mean, "no door" disguises a terrace? - but then at least a floor-to-ceiling window could be provided there.

There is no neighbor of the terrace/garage. Next to it is public land. There is a walking path and hedges/lawn.

You get to this terrace next door through the terrace door.

Who do you mean by “Stempelaugust”? The person at the office who approves the building application or the person who is authorized as the template on the building application?

Does it make sense to simply not include the terrace in the drawings now?

It may be clear to you what you mean, but I still don’t know if I am correct in my interpretations or not.
