stupid question but what if it was contaminated? and how do we find that out – based on this soil analysis where the landfills want?

Apart from that, there is a contaminated sites register for the soil, where a contamination should be listed.

It doesn't always have to be the old chemical factory or gas station.

Soil can also be naturally contaminated or, for example, mixed with construction debris (from other builders 50 years ago...). That makes it expensive.

Z0 (i.e. clean soil) is quickly exceeded.

And because you’re lucky when building anyway, even more and stricter parameters apply from 1.8.2023. The LAGA (e.g. Z0) will then be replaced by the Ersatzbaustoffverordnung. So if you commission an expert report/analysis, directly say whether the construction will take place before or after 1.8.

(And the experts are all helplessly overloaded (and overwhelmed) because of the changeover)

From the few posts of the OP, I have the feeling that probably no questions were asked. And the general contractor probably just thought that they had informed themselves accordingly beforehand, as certainly some of the builders do. Of course, it can also be that it is such a con artist, but it can also be that the OP is not showing everything here. Every coin is known to have two sides :)

My experience that being smart means NOT equating the involvement of a lawyer with an intent to escalate is not meant to be condescending. I trust the expert to find the right tone.


I meant that a house, budget-compliant under the new conditions, would be about 30 sqm smaller (perhaps five more or less). (From my point of view) it goes without saying that it would have to be a smaller model, because – as correctly noted – just trimming the previous design would not be a successful operation.
