Difficult Plot and Monument - §34

We have the opportunity for a minimally invasive component exploration, with the aim of finding out the structure of the walls and ceilings before they are put under protection. Does anyone among you know what to pay attention to?

So, I would like to keep you updated. The component survey revealed that the walls and staircase are original to the building period. As a result, the entire building and the floor plan are now protected as a historic monument. This means we have to abandon the plan to integrate the house into the new construction. The property has been surveyed, and now a new building has been proposed by our architect, which already makes us happy (except for the construction costs). I would like to use the collective intelligence here and gather comments on the plan. However, I am not sure who holds the rights. Am I allowed to upload the plans here since I am the client, or would that violate copyright?

That depends. Copyright is not transferable. The creator is the author and will always be. It can be contractually agreed whether or to what extent rights are passed on. As a photographer, I have stated in my invoices that the clients may use the photos for their intended purpose without my name as the author, including online. I assume that since you did not commission a town hall or a piece of art, the architect probably has not created a uniquely special architecture or building style over many years, but simply planned a house design with great ideas, I would take a relaxed approach. If an architect objects, they might possibly not be convinced of their own product. Otherwise, it can only be free advertising. So if you upload the architect's design here, and a stranger downloads the design and uses it elsewhere, that person is committing an offense. But that basically applies to any image material.

In addition to ...... the draft is not simply reusable due to the special features of the property, but rather is certainly very individual.

Okay, here is the first draft. The goal was to comply with setback areas and gable height. The survey showed that the wall on the south side is quite far onto our property. That’s why you can get close to the wall and there is no wide terrace on the south, but the house doesn’t have to be so narrow. It is still unclear whether we will swap the kitchen and living room, both open. If you have any questions, feel free to ask. And this is a first draft, so the perfect time for constructive criticism. Even if we should build smaller (I’m happy about every cent saved).

So only the little witch's house must remain (original) as it is, and the rear house is to be replaced. How is the little witch's house supposed to be used then (because if left unused, it will eventually decay, which would be nonsense from a preservation point of view)?
