No... of course you don't start a legal dispute there. Such lawsuits are, if at all, only brought by consumer associations. I had originally planned to take out the fire shell/construction insurance/building insurance through Provinzial as well. That would have been fine too.

Update,
I was now in contact up to the authorized representative of ÖRAG, and five different brokers,
all confirm that the builder's legal protection insurance with ÖRAG does NOT exist on its own.
This is definitely the status as of 08.2022.

This is also the consensus in another large forum, that it is not possible to conclude the BH RV with ÖRAG without additional insurance.

Well, it is undisputed that OERAG doesn't want that. The question was whether what OERAG wants here is lawful. says no. I have no idea, and it wouldn't be worth it to me to enforce that either.

It was (or is) disputed whether it is possible to conclude a BH RV without additional insurance.

Yep. darksun was more about whether it is possible. I included the legal aspect because at that time it was confirmed to me, among others, by my Allianz representative. I also didn’t want to come across like "I can make the impossible possible." In short: it (no longer) works without additional insurance/financing. Whether that is legally correct must ultimately be decided by a consumer association. However, the product is too niche for that.

I came across this topic by chance. Since we were financed through Sparkasse, we were invited to a lecture by [ÖRAG] and decided to take advantage of the [BH RV]. We hope we won’t need it, but it helps us sleep better. We did not choose it because we fundamentally don’t trust our general contractor; rather, it is the global situation that prompted us to take this step. No one can guarantee anything anymore, so having coverage for the worst case was our reasoning.

However, I did not know that this insurance is only accessible to a specific group. I find that a bit strange as well. But I think a large insurer like [ÖRAG] has had this "selection" reviewed by its legal department. Ultimately, they don’t have to insure anyone, and apparently, they do make use of that.
