With us, a minimum of 3m also applies. At a height of 9m, I come to 3.4m on the flat roof, which is not a problem with 3 sides. On the street side where there are no parking spaces, it will have to be seen. However, the neighbor has built in the same alignment with a 1m distance to the street.

The roof shape is not a criterion of the insertion requirement under Section 34!! ;)

Learned something new again. Here is a quote from the practical commentary on § 34: "The integration requirement of § 34 para. 1 sentence 1 of the Building Code is widely misunderstood to mean that a project must fit into its immediate surroundings in every respect. Thus, projects are sometimes rejected with the argument that they do not stylistically integrate into their immediate surroundings (for example because the project has a flat roof instead of a gable roof). The response, with a look at the law, is that roof shapes or other design features are not covered by the integration requirement because they neither affect the type or extent of the structural use, nor the construction method, nor the buildable area of the plot."

Yes, that is really important because it is widespread at regulars’ tables, I just described it in detail in the other thread (think I linked you too ;) ), we almost planned differently because of it, I just want to help prospective builders in a similar situation.

Taste-wise correct, but practically often still. If you don’t want a shed roof, it probably cannot be rejected in the §34 area just because someone "doesn’t like the nose". But a shed roof has, with the same pitch, double the eaves-to-ridge height difference compared to a gable roof, and thus also a basis to kick it out on the parametric level.

So after the meeting with the building authority, the regulatory office raised concerns about the parking situation. The turntable ladder or garbage collection could not turn the corner if people park on the street there. Therefore, they advised me to limit to 2 floors. My suggestion, however, was that with 3 floors I can reduce the footprint and keep more parking spaces available. Also that we arrange a personal meeting to find a common consensus. In principle, the municipality is also interested in a joint solution.
