That is fraud, and to prevent it, our bureaucracy and formalism are growing more and more.

Why should anyone complain if I don’t apply for any funding?

Read from the beginning. Of course. This concerns normal basement areas (where underfloor heating in the basement is not uncommon). Not living space or the intentional reclassification of rooms to become eligible for funding. You can of course plan your boiler room as large as you want. But you must also build and use it accordingly. You don’t have living space—just like in the basement, even if, as thought here, the daughter sets up her room downstairs --> which is legally not allowed. Therefore, there is no point in building 120 sqm living space and 30 sqm boiler room instead of 140 sqm living space and 10 sqm boiler room. You want to and are not allowed to live in the boiler room.

And what if the OP applies for a reclassification of the basement at the building authority in a few years? He pays a few bills and everyone is happy, right?

He can do that. But then he must also meet all the requirements for the change of use - windows/lighting, room height, escape routes. However, I am now at a loss regarding what the L-Bank conditions say, whether and which deadlines must be observed for expansions or area enlargements. For the KfW, for example, there are explicit regulations if something is to be changed on the house.
