I just spoke with the district office. The 16m privilege was abolished in 2021.

On February 1, 2021, the amendment to the Bavarian Building Code (Law for the Simplification of Building Regulations and for the Acceleration and Promotion of Housing Construction) came into effect. The newly designed authorization to issue statutes to determine deviating depths of setback areas in Art. 81 para. 1 no. 6 BayBO had already come into effect on January 15, 2021.

The depth measure of setback areas will in future be set at 0.4 H in municipalities with less than 250,000 inhabitants according to Art. 6 para. 5 BayBO. In commercial and industrial areas, 0.2 H applies. However, the minimum depth of 3 m remains. The 16m privilege is abolished.

I meant whether it is one of the preliminary drafts (service phase 2) or already the draft (service phase 3).

I would be interested to know whether a fixed glazing is possible in the fire protection wall to the neighbor.
