Garage structurally independent - What exactly does that mean?

I think it won't work because it is a boundary building. Therefore, the garage has to be independent... which also means it has its own roof.
In theory, you should be able to simply detach the garage without the house suffering any damage.

But I wouldn't want to be the architect who screwed this up :cool:

which paragraph or article or whatever explicitly states that a house entrance 5 meters from the boundary counts as "border construction" just because it belongs to the garage. I cannot find this regulation, but everyone refers to it.

The hallway section is functionally part of the house and may not comply with the distance?

The above-mentioned reference applies only to the old version of the BayBO, which I found searching on my phone, and previously read:
"The structural connection of this boundary building with a main building or another ancillary building is permissible, provided that these buildings individually comply with the distance requirements applicable to them"

According to current law, the argument[B] no longer directly arises from (now) § 6 para. 8 BayBO. It specifies the conditions under which a garage does not have to comply with distance requirements. The connection of buildings is now regulated in a different context under § 6 para. 6 sentence 3 Bavarian Building Code.

If now a part is no longer functionally a garage but a house entrance, in my opinion, a use is added that could, but does not have to, remove the privilege of boundary building, as the building authority’s notes here show. The distances for the hallway as part of the house are also observed depending on the height H.

I would therefore ask the authority again for the exact legal basis and arguments they rely on.

You are mixing things up there. The LBV tells you how to handle the setback areas.

who says what about the state building code? i asked where you always get this story about the constant separation from. i have never read that anywhere and the official from the office also said that this is nonsense here in SH. according to the district building authority, the only important thing is that the corresponding buildings start more than 3 meters from the boundary if they are attached to buildings with special rights (garage/carport etc.). we have a terrace roof attached to the carport. the carport stands at the boundary, the roof starts 6 meters from the boundary but is structurally connected to the carport. according to the district building authority, this is fine. for the neighbor, there is no difference whether the roof is attached to the carport or not. from the neighbor’s property, they wouldn’t see whether there is 1 cm of space in between or not anyway.
