Trying to save what can be saved – this architect (?) will have to completely redesign if he wants money from you because this is technically wrong and bad and it is a misconception that an architect can plan whatever he wants and then must receive the fee.
If he does not want a complete redesign – which I hope for you – then agree on a payment for the separation.
Yep, exactly.
Certainly, it will probably get worse during construction, so for me only separation would be an option. Surely nothing/not everything has been paid yet, so he would have to consistently demand that from you then. Everyone can confirm the absurd defects or the missing implementation of your requirements; the guy surely knows that too and he also surely knows that he handed over such rubbish to you.
A factually justified and clear letter with an offer for a payment could be a workable way; what could possibly happen?
It strongly reminds me of my own experience from what feels like 100 years ago during the first build without any knowledge. The plan came from the family construction company and back then the foreman would have been enough as a signatory since we built with the then green dot. Because of two small deviations, however, an architect had to at least sign and I was young. The exterior view then did not match the floor plan in details, e.g. with tight window planning, etc., and he asked us if he could also contribute his own idea. I said "why not" and in the end I paid a similar sum diligently (I certainly wouldn't do that again), although we threw the floor plan right away into the bin because truly nothing of our wishes was in it.
I am curious how things will continue with you.
