How is the property actually advertised? Without a developer or with one? It at least sounds as if only the property itself is being sold. Then I would go to the owner and ask if this is in his interest. And that one wants to buy, also with a realtor (without one the owner probably doesn’t want to), but not under the conditions set by the realtor. The higher property transfer tax would also be a thorn in my side. Regards

It is advertised without a property developer. We have not approached the owner. We assume that he has some kind of restrictive contract with the agent if he does not agree to a sale outside of it.

The property is relatively large and is to be sold in two parts. One part has a lot of agricultural land that has to be removed. Both properties have a building area of about 700 sqm + garden area...

It is common with broker contracts that you could also sell alongside the broker, but then he also earns as if he had brought that customer. In that respect, the seller knows that he is "tied up." If the broker is also doing something underhanded on the property and the seller has not agreed to it, that is a breach of trust by the broker. So the question "Did you already know / what do you think about it" is something I would definitely ask the seller. Asking doesn't cost anything.

hm, the question is also how the land purchase is linked with TAFF.

If there is no obligation to build with TAFF in the land purchase contract, it only needs to be ensured that the construction contract is not signed before the notary appointment.

I certainly know cases where, through excuses, it was possible to persuade the real estate agent/the construction company to first buy the land and then want to sign the construction contract afterwards (which, of course, then did not happen).

You can initially push the land purchase and superficially continue negotiations with TAFF.

Is the land already divided?
