Land purchase as well as construction financing is split 50/50 and is also contractually regulated that way.

Last week we received the preliminary draft of the notary contract, with the request to review it and indicate any possible changes.

What I noticed is that so far only I am listed. However, my girlfriend should also be included in the notary contract as well as in the land register. I will now raise this with the notary.

Is it still common for me and my girlfriend (since we are not married yet) to be registered together in the land register as a civil law partnership (Gesellschaft bürgerlichen Rechts, GbR)?

Is there another option or possibly a better variant?

From a tax perspective, it should not matter since the house is not being rented out and I cannot deduct any property costs anyway if I am correct, right?

Good morning everyone,

to keep you briefly updated here as well, I am happy to share that the desired plot of land has been in our (my girlfriend’s and my) possession since the beginning of the year.

Considering several factors as well as the price and the undeveloped eastern location (sloping downward) and the fact that the plot also slopes slightly to the south, which I think is fantastic.
We couldn’t quite reach our desired size but with 770m² I think it’s definitely sufficient.
It was important to us that the plot could be paid for from own funds, so now it means saving more equity / getting rid of all possible other debts until the beginning of 2018 (start of construction).

Planning regarding the house will then take place / start after the wedding (mid this year), end of 2016 / beginning of 2017.

Certain forms or types of houses are already in focus (towards a city villa with a hipped roof) which is why a preliminary building inquiry to the municipality was already submitted before purchasing the plot to clarify whether we are allowed to build what we imagine.

    [*]City villa with 2 full floors and hipped roof was approved.
    [*]Garage unfortunately only with hipped roof (no flat roof allowed)
    [*]Furthermore, due to an already existing house in the row, we are also allowed to build beyond the building line and thus up to 8m to the boundary in the east.


I’m curious how it will continue, even if it’s still hard to imagine a house on the “small” meadow.
