General waste is not the big problem. Poroton, iron parts, Styrodur remains are clearly identifiable.

What did your construction company say about that? Before asking in the forum, I would have called them first. A lawyer is always an option, but is it really worth it?

We worked very cleanly, everyone has taken their dirt with them so far. What we did: I collected a bag full of Styrofoam scraps -> yellow bag. One afternoon we cleared the garage + driveway of (many) nails and (few) plaster chunks, some pieces of wood, smaller metal parts, etc. That was about 3 plaster buckets, which then went into our residual waste and that was it.

Why a lawyer? If I withhold money because something is not done properly, I am not the one who needs a lawyer, but the contractor if he believes I am withholding money unjustly.

The general contractor said the landscaper should simply mix the leftover Poroton blocks in with the earthworks, and the cigarette butts as well. That is normal and he had never heard otherwise. The landscaper, on the other hand, says he frequently has these problems and only when the building owners withhold money does it work in some construction projects.

I wouldn’t have a problem with that either.

If it is not stated in your contract and you have not commissioned it, then it will be your task. Just like mine and all other new building owners' tasks as well.

So you are of the opinion that the quote from earlier by me is wrong? If yes, what do you base this on? Also, the question would be why do they all "clean up" anyway if they do not have to do it?

On a relevant website I just found this:
"According to VOB/C, the disposal of waste from the contractor's area as well as the removal of contaminations caused by the contractor's work are ancillary services that belong to the contractual performance even without being mentioned in the contract."
