Hey,

that someone other than me is still awake so late

I doubt that a 20-40 cm boundary distance can make the difference between total darkness and light-flooded rooms but I don’t mind.

May I ask again what you mean by "apply absolutely"? That I can basically transfer this "rule" to the street side? Even though the street side is outside our building window? Or does the building window have no influence on privacy windows? The same applies to the garden shed. Six meters is already not bad, but is the garden shed allowed to stand outside the building window? Or what distance do I have to keep from the street again? I simply can’t find anything regulating this. It’s always only about agricultural properties and other properties. Or is the street also another property?

Where (if not in the development plan) is it regulated what I am allowed to set up in front of my privacy fence or that the ground must be greened? Does anyone know that? Can I not designate it as a path and pave it? Or place a small elevation on the property boundary and sprinkle pebbles in between? Or simply any climbing plants or bamboo or such plants.

A garden shed up to a certain size may also be located outside the building window. The garden shed is included in the boundary construction. However, it is not a "structural facility" (State Building Code) or something similar. Privacy fences count as partial privacy protection and do not serve as a complete enclosure. That means: for example, they are placed on the terrace where no planting serves as a privacy screen. Hedges and bushes are used in the garden not only for their fruit but also as privacy protection, for example on the terrace. A property and a garden are also usable without privacy protection or a fence.

An architect should have the State Building Code etc. in mind and be allowed to face your questions every day. She is responsible for drawing the installation shaft.

Have you ever considered washing the laundry on the upper floor?

Edit: there is also neighborhood law as well as the State Building Code for regulation.

How tall are your neighbors' fences around their houses? Here, almost everyone has a 1.2m high fence around the house, even in the front yard, although only 70cm would actually be allowed in the front yard; no one has ever complained. You could also make a lower fence and plant a privacy hedge behind it, for example "Thuja Smaragd", which also requires little maintenance.

Afaik, a distinction must be made between fencing on or directly at the boundary and privacy screens. Here, fences are also strongly limited in height, so people plant a hedge with the permitted height as a target and set a higher privacy screen behind it.

Good morning dear ones

The news about the garden house is really good! I have researched again and found the following in the State Building Code BW:
" Buildings without living rooms, toilets or fireplaces, if the buildings are neither used for sales nor exhibition purposes, up to 40 m³ in the inner area..."
The visible point is also the narrowest at 6m, so I can solve it with a garden house if necessary. Now I am relieved!

Since we do not want any hedges or other greenery, the fence will be our only privacy screen. Greening is also not required in the development plan.
The following is stated in the Neighborhood Law BW:
(2) Opposite other properties, dead enclosures - except wire fences and barriers - must maintain a border distance corresponding to the excess height that exceeds 1.50 m.
This is what the lady from the city building office also told me.

Regarding the distance to the street side, her answer was:
"The fence height or also the height of a hedge along the street must be finally clarified in a procedure. Urban planning and traffic aspects also play a role here."
Whatever that may mean. The architect said that this will be clarified in the building permit.

: It is already extremely important to us that it is not visible. Our garden does not only consist of a terrace. I want to plant vegetables there, set up a pool and eventually let children play. This is my private space and I want to be able to move there without being stared at. After all, no one wants someone to come into their living room and first wave to the neighbors.
Unfortunately, we have no more space for a laundry room in the two upper floors. But I also cannot imagine it because of the noise level.
And thanks for the hint on the state regulations, that’s exactly where I have dug now.

: That’s exactly the difficult part about our situation. The houses in the neighborhood are all a bit older. Some have barns and most have a yard with a garage driveway. This yard is then not fenced at all. We are not planning a garage, so I can’t really copy that. As far as I can see, their gardens all go out the back. You will not have to reinvent the term garden. Almost everyone desires privacy. You also do not have to assume every neighbor is prying. Basically, everyone else is only as bad as you are willing to assume they are. Anyway: a garden is usable even if you have neighbors or a pedestrian passes by, vegetables do not care either. And a garden is also defined, among other things, by greenery... that a fence is supposed to serve as a privacy screen is new. You combine it with proper privacy screens -> hedge, bushes, partial privacy wall (didn't I already write that?!), a garden layout is a combination of everything. Hedges and bushes are often placed across the boundary, simply to delineate different spaces in the garden or even as a windshield. A garden planner also helps well, it is available online for free.
