Isn't that practically already an approval due to the deadline expiring?
I didn't read the entire state building code, only the relevant parts. But the deadlines don't specify what happens when the deadline expires.
So a deadline is set, but without sanction or consequence. The funny thing is that if the municipality or a participating authority (e.g. environmental office, etc.) doesn't respond within 1 month, it is considered approval. But this does not apply to the final release by the building authority. In the end, what I lack is the written building approval or the red dot – without that I can't start.
Our friends had the building authority ask a question shortly before the deadline expired, so the deadline did not expire.
According to the state building code, however, the deadline is only "paused" for the duration of the inquiry. So if, for example, I receive a query on 01/15 and submit it properly on 01/20, then, according to my understanding, the deadline may only be extended by 5 days.
But I can tell you, we had really serious issues regarding deadlines etc.
As I said, I’m happy to report on it, but only once I have the approval in hand. You never know...
