Our building permit is here and promises must be kept:
We submitted our building application in the simplified procedure to the municipality at the end of August 2020. From there, it was forwarded directly to the district office, and the confirmation of receipt came at the beginning of September.
The municipality then carried out the adjacent property owner hearing, during which the neighbors had 4 weeks to inspect the plans and possibly object. Luckily, nothing came from them, and the municipality gave its approval at the beginning of October. The documents were sent directly to the district office and were recorded as received there in mid-October. We then waited excitedly for the building permit.
A brief digression: according to the BaWü state building code, the building authority has exactly 10 days after receipt of the application to check the documents for completeness and, if necessary, request documents. That would have been until mid-September.
At the beginning of November, the district office got in touch in writing to say that the documents were incomplete and that they still needed documents and additions to the building application. Since the deadlines "pause" at that point, we obtained the documents as quickly as possible and had the changes made by our architect as well as exchanged the plans about a week later. About another week later, we also called again and kindly asked whether anything else was missing or any further changes were necessary, which was denied over the phone.
At the beginning of December, we then received the message that the dormer was somewhat too large for the district office and we should revise the plan. Here, too, we reacted immediately and exchanged the new plans three days later. Before Christmas, we asked again whether there would still be a building permit in 2020 – but there wasn’t.
In January, we heard nothing more but did not want to call the caseworker constantly and cause annoyance. When, at the end of January, there was still nothing, we asked again. You could tell he was completely surprised and then came up with various excuses. My personal impression was that he simply forgot. He then said he would take care of it.
In mid/end of February, we finally received the building permit, whereby the written part (creating documents, signing, etc.) took 2 weeks according to the system.
Conclusion: almost 6 months for the building permit (or 5 months excluding the additional submission times), although the state building code prescribes only 3 months or even only 2 months in the simplified procedure. But as Evelyn already wrote, what can you do? In the end, they all hold the stronger leverage and rather ensure that it takes even longer. I just find it cheeky that the state puts clear deadlines in the state building code and the reality looks different.
