Due to the rain, the basement will not be completed on schedule. That is not a problem at all. However, the acceptance is supposed to take place tomorrow. The friendly site manager from NSK pointed out to me that, according to the Building Code § 640, I am obliged to carry out the acceptance. But if not everything is finished yet, that doesn’t make any sense, does it? Since I have zero trust in NSK and their site manager, an expert will be present at the acceptance, and I actually don’t want them to have to come a second time.

Yesterday I was still on the phone with the lawyer, who then explained to me that acceptance cannot take place as long as the basement is not finished and that our construction contract in this case provides for a condition survey, which is explicitly not an acceptance. As can be clearly seen in the photo, the basement is not finished.

The construction manager sees it differently and said that I would then refuse the acceptance. He probably is also familiar with legal matters. As a precaution, I took photos of all possible views that document the state of the construction progress. It should be noted about the basement itself that the construction crew worked to our full satisfaction.

Now the basement is finished... and the light wells are installed too high. The site manager from NSK gave incorrect instructions on where they should go. It's stupid when a site manager cannot read the architects' plans. According to them, they should have been placed at the bottom edge of the basement ceiling, but now they are at the top edge of the basement ceiling and need to be moved. But what are 18 cm, one could just turn a blind eye. However, I won't.
