Hello everyone, we are facing a similar dilemma with the application. Does anyone have experience as to how relevant this point is in the context of the later BnD? Do land register extracts/purchase contracts etc. have to be submitted later? Regards Paul

I am not aware of anything in this regard. The KfW also receives exactly zero documents from you.

Regardless, it would be a procedure that is practically impossible to implement. The application must be submitted before the start of the project. So before the conclusion of a purchase or work contract (this also applies to the purchase of a condominium or a developer).
The priority notice of conveyance is approved in the purchase contract and then entered in the land register. Therefore, funding for a condominium purchase would be absolutely impossible since the priority notice of conveyance only appears in the purchase contract. It cannot exist beforehand.

Well, if it’s about a new building, the land could already belong to you or might have been purchased with your own funds. I agree with you when it comes to buying a condominium or through a property developer. There is a passage in the leaflet for the measure stating that you must be the owner, tenant, or lessee of the property. It’s kind of complicated.

Here it simply must be distinguished. In the case of a first acquisition from a developer, e.g. an apartment unit [ETW], the application must be submitted before the purchase contract is notarized.

If you are the builder yourself, you may only do this once the priority notice of conveyance for the purchased property has been registered, but before the construction contract has been signed. If you already own the property, only the construction contract must not yet be concluded.

The risk actually exists that KFW will take a closer look at you after some time, especially these days and weeks in the final stages of the funding.

Then it could happen that the entire funding is canceled after some time. I spoke with KFW a total of 4 times in January, and each time I was directly and unequivocally referred to FAQ point 2.4, where this is explained in detail: Only those who are already owners of the property are eligible to apply.

Since the land registry office also takes some time—sometimes 4-8 weeks—that was too risky for us.

You get really frustrated when suddenly they say: there is no 27k EUR!

Yes, this uncertainty is the annoying part when you invest additional costs for Kfw55 and later receive rejection due to a formal error. Should a rejection come within a foreseeable time (3-4 months)? Then one could possibly still react and switch to Kfw40 or not do it at all if one has not yet started. That would be too much of a risk for me as well.
