This is not about being deceived, but about the assessment of real estate transfer tax by the tax office. At the moment it is clear which company will build on the property after the purchase, real estate transfer tax may also be due on the house. There were partly some peculiar interpretations by tax officers when determining the real estate transfer tax, even though there was no economic connection between the property seller and the house builder.
The questionnaire from the tax office then contains a few tricky questions, such as:
- do you plan to develop the property ("of course, otherwise I wouldn’t have bought it")
- how did you find the property ("well actually the guy from the house building company... oh no, I’m not allowed to say that now... I asked at the municipality")
- do I have offers from several companies ("of course ... I had them made especially for you")
- are the offers still valid or have the negotiations already ended ("of course they are still valid, I haven’t canceled all yet on purpose")
- have house building contracts already been signed ("not signed yet, but I’ve had them for weeks")
And of course, everything must be properly documented.
