I’m with you on that. We have the appointment with the two responsible parties tomorrow.

I have one more question for you because you mentioned the possible balcony/terrace on top of/by the garage. Suppose you build the garage with, for example, a width of 4 m on the western boundary. In the development plan, a setback of 2.5 m from the boundary must be observed. Can I then theoretically use 1.5 m of the garage as space for the terrace and then, for example, connect a loggia inside the house? Not that we would necessarily consider this, but I’m wondering if it’s theoretically conceivable and compatible with building regulations.

This cannot be answered in a general way. Here in Saxony, a garage loses its privilege—zero setback from the boundary—as soon as it belongs to the house, which is the case due to the terrace (point 1) and (point 2) the parapet height would then exceed the building height at the boundary.

We had planned a double garage as a boundary building and have now solved it by making two single garages: one directly on the boundary without a roof terrace, only a green roof. The second garage next to it then has a terrace and maintains a 3m setback from the boundary, and everything is fine.

Yes, that's true. But the decision should not depend on that. Therefore, one can also consider it at a later point in time.

According to the development plan, the row development below even has an allowable building length of up to 80m. Does that mean it will definitely be built continuously? A developer wouldn't miss the chance to build a "block," would they? It would be too good if it were built with interruptions. (I know it that way from another new development area from acquaintances near Stuttgart).

I just can't find the development plan right now, but can't you tell from the planned plot widths?

With a normal terraced house width... about 7m or so, there isn't enough space to build an end terrace house with a 3m distance to the boundary. (there would only be 4m left for the house)

For wider plots >10m, it can be assumed that a block will end there, since no mid-terraced house will be wider than 10m.

I think this will rather be a multi-family house. It is a continuous plot:



According to the development plan, an uninterrupted row of up to 80 m is exceptionally allowed.

Maybe not a multi-family house either, I think they will be individual townhouses and regarding the property there will then be some kind of partition declaration or usage right, where each owner is assigned the land under their house + garden. The heights are clearly defined: 13.5m at about 16m distance from your terrace. Hmm, they are building with an underground garage, so the railing will probably be higher rather than lower. There will likely not be much sun left in the evening :-(
