You should have received the notification of conveyance from the notary, right? Have you called the cadastral office to check if the map might be available by now?



But how is that supposed to work? The priority notice of conveyance must be recorded in the land register and new parcel numbers must be assigned for each of the new subdivided plots and each must have its own land register sheet, right? Or am I mistaken?

unfortunately, we have not received anything yet. The land registry office also has nothing so far. Today, Imaxx assured us that we only need to pay once the financing is finalized. A letter for information has also been sent to the notary.

The priority notice can also be recorded in the land register of the property to be divided. As mentioned, for me there is still no survey, parcel numbers, etc. for about 30 actual properties to be divided, all of which are already inhabited. According to the land register, there are only 2 parcels, each almost one hectare in size. This was not a problem for either the bank or the lawyer who reviewed the contract for us.

Exactly! First, you must receive a notification that the municipality does not have a right of first refusal or does not exercise it, then the notification that the priority notice of conveyance has been registered, and then, when the construction road with the initial development is completed, you will receive the payment request. The notary could also send you all three notifications at once. So no payment request either? Maybe you will find more in the notary contract, e.g. whether the priority notice of conveyance is to be registered on the old parcels or the new parcel, or whether the land charges can already be registered before the transfer of ownership. But as already said, the notary should have explained this to you at the signing appointment.

Just out of curiosity: What happens if one of the other 30 property owners wants to sell their house? Or if the financing fails and the bank wants to auction the house? Do you then have to wait until the survey is completed?
