I would say, let's continue discussing this in my thread so as not to further deviate from the topic here.

Please excuse me for not responding for so long. This was my first post in the forum and I am positively surprised by your thoughts. A few more details about the situation: - there were already disagreements during the planning phase and we presented our point of view in several emails and escalation meetings. Mostly without any response from the manufacturer. - among other things, we discovered a problem regarding the balcony during planning and in an escalation meeting with the sales management and executive board a technical alternative was proposed to us. Confirmed by us and the technical feasibility was also confirmed. - the planning was so poor that the earthworks contractor, when he wanted to start the excavations, found that the specified height indications were incorrect - during the shell construction we found that 2 walls were produced incorrectly. Based on our hints, the foreman on site shortened the walls with a chainsaw - during the shell acceptance we discovered that the balcony was produced/installed incorrectly contrary to the promises - rejection of the partial payment until clarification - no response from the manufacturer for 3 weeks - after repeated inquiries, suddenly cost increases appear because the planning was so complicated and they should be offset against the damage to the balcony - personal conversation with the former owner (now only managing director together with 3 others) - solutions discussed (financial compensation and completion of the construction this year) - further cost increase. I objected to this cost increase by email (not accepted) - further conversation with the former owner sought. Conversation is blocked. - email from the managing director that work will be stopped until cost increases are signed by us and the partial payment is made - partial payment paid minus a retention - work stopped this week - yesterday an email indicating that next week 6 fitters will continue the work on site. We should reserve rooms (agreed as such) - today an email from the managing director that work will not continue next week if the cost increases are not signed by tomorrow noon. Your opinion?

One more thing forgotten. We have engaged a lawyer (fortunately, builder's insurance taken out). Not aggressive, but de-escalating. We are still considering whether the next email should be written by me or by the lawyer.

I have to mention here that writing an email when you want to complain or express dissatisfaction is certainly easier than yelling, however, an email is the worst form of communication at all. Maybe next time you should choose another form of communication if something serious is brewing - I think the lawyer agrees as well. The written word is very patient… not infrequently one reads something differently than it was meant.

That is probably true. However, if conversations are not possible or are subsequently interpreted differently, you are lost without an email. We are currently paying a high price for our good faith and trust in the honesty of others.

With the complexity, I would only recommend a lawyer. You quickly lose track.
