I am following your thread with much interest, sympathy, and respect for your energy. That way, I certainly do not know everything yet. Therefore, I am surprised that you are opening another possibly vulnerable front where you have to fight.

That is wrong. To prevent exactly that from happening, we had him file a lawsuit.

As far as I know, a lawyer can take up to 36 months before his claim expires. Intentionally losing a case is not wise because, in addition to the €1,600, you also have to pay all the associated costs. I don't think you will get that back.

The wording of my response to the lawsuit is as follows: "Therefore, I see here poor performance or defective service (§611 Baugesetzbuch) by the plaintiff. The defendant side has suffered damage due to the poor performance, whereby I assert a right of retention regarding the plaintiff's cost calculation and alternatively offset it." I am not even claiming that his claim has expired, but 18 months seems quite severe to me. But don't worry, he still made enough from us and even more from our former adversary. Unfortunately, it seems he then had no interest in properly finishing it.

One thing kept bothering me while vacuuming, so I quickly googled it again: Isn't there a lawyer obligation starting from a dispute value of €5,000?
