Development plan unclear regarding the number of floors and height on the slope

Situation 1 would be the case for us. But our wish would then be that the ground floor is not level with the street, but lies at approximately 2/3 of the terrain rise (it’s hard to tell from the drawings since the house almost covers the entire plot). (Schematic as in the attachment). And in this scheme, nothing is marked with 70 cm. How high may my floor be above the underlying street in situation 1? That is the question.

The plan applies uniformly to the entire area.

Yes, exactly, it is reserved. But when we extended it, we were already told that this only works exceptionally because there are no other interested parties yet. So I’m curious what will happen when others come along. But one should also be given enough time to clarify this.

The person from our construction company made the elevation plan, but I don’t have it here right now.

Shouldn’t there be someone at the municipality who can tell me exactly whether our project is covered by the development plan or not? I would only submit a preliminary building enquiry if I already know that I want to build contrary to the development plan, right?

Haven't you asked there yet? That would be the first step; whatever statements we all make here ultimately have no value other than forming an opinion.

I asked, but I'm still waiting for a response. Of course, you're right, I can't buy anything from that. But I was interested in an assessment over the weekend. Seen that way, all questions about development plans are rather irrelevant here in the forum :) I'm definitely grateful for all the answers and opinions.

No interested parties? That is initially good, presumably due to the current situation. I have also withdrawn my reservation.

Your project is not covered by the development plan according to the information you provided. The building authority can also tell you that. They know the development plan and unfortunately, we do not here. You can call them and ask what they think of your idea. However, I would like to have such an answer in writing.

Therefore, our advice is to submit a preliminary building inquiry.

What is the height above the street for the building limit? And even if you do not add fill, you may still have to support it. Slopes are always only moderately usable as gardens. Take the elevation plan from the surveyor and mark where the house will be and what you will then have to do to get the terrace, etc. The problem is indeed triggered by the development plan, but it is not limited to that alone. If the bungalow is dug into the back, that also has consequences. And what is your motivation for a bungalow compared to other house types? Since a bungalow has to accommodate the entire area on one level, a hillside location is doubly unfavorable there.
