I see it this way: Par 33 ‘the disturber’ is the dog owner, or the dog. The OP is then obliged to provide the enclosure, then according to Par 35. But I am neither a Westphalian nor a dog owner :cool:

I would choose the wire mesh fence and cover it with plants. That looks much nicer than any mats.

You are mistaken, since he is building a fence, he is not a trespasser.

The local customary practice regarding enclosure is mentioned so that a neighbor who demands it, for example, cannot insist that a 1.43-meter-high marble wall be built just because they find it attractive.

You can see from the comments that it really is a matter of taste. We now have a [Doppelstabmattenzaun] and have ordered the same for the new property (partly with privacy screen where the pool will be). The fence is stable when the children climb on it, low-maintenance, and can be greened.

A hedge is nice, but takes a long time to grow, you have to water it diligently, and it takes up a lot of space. There is already a hedge on 2 of the 3 sides of the property and you easily lose 1 meter.

If you need privacy, you can plant ivy. It grows quickly and becomes completely dense. My neighbors did that and it looks good. Nowadays you can also plant something different or plant other plants in front of the fence to loosen everything up.

You have to be careful with ivy. The neighbor's ivy regularly grows over the wall. I can't tolerate it at all and my husband also gets itching when cutting it. I can't confirm watering hedges. It probably depends on the soil and the plant. If you have one with a high water requirement, irrigation makes sense.

Whereas ivy is not an issue for the OP. With the requirements, it will probably really stay with welded wire mesh or WPC (more expensive) once it is clarified whether a gravel strip counts as a rock garden.

No matter what kind of fence you use, consider whether you want to embed a lawn edge under the fence. Otherwise, you will have to manually trim the grass along the fence.
