With a distance of 50 cm for example. Or even one meter... it depends on how thick the hedge will be. It must be guaranteed that nothing grows over the property boundary onto the neighbor’s side.

For a cherry laurel hedge, one plans for one meter depth; for a trimmed hedge like hornbeam, it can be somewhat narrower. According to neighborhood law, for example, plant it at least 50 cm away from the property boundary. Then it may grow up to 1.80 meters high.

Exactly there it should go. That’s how the city planners envisioned it. A shared hedge on the property boundary. The planting is paid equally. Everyone maintains their side. I also find the wording in the development plan clear: Enclosures are only permitted as deciduous hedges ... The fact that additionally fences are allowed is a concession by the city planners, probably so that the young dog of the young family does not explore the neighborhood on its own through the young and thus still permeable hedge. The planners probably could not imagine that neighbors might come up with the idea of erecting two visually opaque fences.
Since your neighbor has already created faits accomplis, you probably have to comply with the city’s instructions now. And if they want a hedge on each side of the existing fence, IMHO there is no way around it.

Not necessary. The development plan is binding.

Hi

I read ".....are permissible" and not "must be carried out one way or another".
From that, I would not even derive an obligation for a enclosure.

No, there is no obligation if the neighbors agree. But here both neighbors want a fence. Unfortunately, it is not compliant with the development plan.

Well, not quite. We would have preferred to do without it, since we don't want the hedge. If we now place the hedge on the boundary, is one side then allowed to put up a fence on the inside, just like on the other sides? Integrated would be clear, but if inside, then both sides would be inside.

Yes. As I understand the development plan, the other side is also allowed to put up a fence. However, it is not sensible and a waste of money besides.
