Exactly there it should go. That’s how the city planners envisioned it. A shared hedge on the property boundary. The planting is paid equally. Everyone maintains their side. I also find the wording in the development plan clear: Enclosures are only permitted as deciduous hedges ... The fact that
additionally fences are allowed is a concession by the city planners, probably so that the young dog of the young family does not explore the neighborhood on its own through the young and thus still permeable hedge. The planners probably could not imagine that neighbors might come up with the idea of erecting two visually opaque fences.
Since your neighbor has already created faits accomplis, you probably have to comply with the city’s instructions now. And if they want a hedge on each side of the existing fence, IMHO there is no way around it.
