Oh. That surprises me.

If the bank then requests documents for the KfW subsidy: How does one get hold of them then? Just asking out of interest.

Sorry, I mean structural analysis and factory planning. KfW should have already completed the documents at the beginning, right? I think so, I don’t know.

On the KfW website, on the information page for the individual funding programs (e.g. kfw.de / 153) under "Formulare & Downloads," there is a PDF titled "Bestätigung nach Durchführung." On the fourth page, eight documents are listed that must be kept for 10 years:



I understand this to mean that these documents are mandatory for a KfW XX house and must accordingly be handed over by the builder/general contractor.

Our general contractor was somewhat surprised by my request, but currently only #8 is missing. For #1, the energy consultant apparently only had to press print once.

No one here can answer that because we do not know your contract with the developer.


Once the construction project is completed, you will soon receive mail from KfW. In it, you will find a kind of questionnaire to be filled out by your developer and accompanied by attachments; then their structural engineer must recalculate and prove to KfW that KfW 70 was actually achieved according to the promotion criteria.


As I said, that depends on your contract.

As an example – we provide before, during or after the construction project: working plans, structural analysis (reviewed structural analysis, if necessary), soil reports (if required for the construction project, including the chemical report), relevant KfW documents, thermal insulation verification, blower door test, subordinate confirmation for KfW as well as all warranty documents and a list of contacts for the trades.

A thermal bridge is not found in the working plans; they also do not arise exclusively from improper execution! However, they should be avoided as much as possible, although it is not always fully achievable.

So be careful with "suspicions"!

Standard answer from lawyers, type A: "Depends....".

Depends on what? Contract, necessity, special or common property, who gets what from whom?

Plot of land. There is no entitlement to building plans.

For exceptions and overview: google for example: "WEG-Report Must the developer/seller hand over plans and construction documents to the buyer?"

And: YOU are entitled at best insofar as it concerns special property according to WEG. If it concerns common property (and that’s usually where the thermal bridge is, i.e. in the wall or ceiling), the WEG administrator is authorized on behalf of the WEG community to assert the claim for release (good luck...) - unless you have been authorized by the WEG community, e.g. by resolution, to request the plans on behalf of everyone.

And the entitlement alone is of little use; if necessary, it must be enforced in court since in practice the developers do not voluntarily hand them over.

Just found on the website of the Association of Private Homeowners:

Also when selling condominiums, sellers must present the energy certificate to the prospective buyer. The certificates are always issued for the entire building, not for individual apartments. The condominium owners' association has the energy certificate prepared and makes it available to the individual apartment owner.
