These are costs that occur independently of the general contractor, namely dependent on the property.

But the seller is out - site manager etc. are other functionaries, maybe that helps a bit.

Oh, the rule should always be: first the plot, then the house planning.

These are costs that occur independently of the general contractor, namely dependent on the property.

In summary: either get out of the contract with a contractual penalty or admit to yourselves that you made fundamental mistakes yourselves and the construction company cannot be held responsible for everything.

Thanks first of all to everyone! No, we did adjust the planning according to the development plan and the house price got somewhat more expensive. The calculated ancillary costs were borderline okay, but the actual ancillary costs are multiple times higher (however, these are items that were already known beforehand, like drainage, sewer connections, etc.). It was just sugarcoated so that we would sign the contract. The deputy managing director then said that he has contacts, but now he no longer takes care of it. We were just too naive. We had little time because I was going on an overseas mission two weeks later and that’s exactly why I go to a general contractor, to have someone with experience advise me. But unfortunately, that was nothing.

The cost risk for services included in the construction contract, however, is borne by the contractor. Provided that nothing has changed in the planning fundamentals.

Free termination at any time. 648 Building Code. Observe legal consequences (rebuttable legal presumption regarding the amount of expense reimbursement at 5%; it can therefore be more or less; issues of proof).

Termination for good cause would be better, 648a Building Code. Also here the crucial question of proof is whether this is sufficient.

Go to the lawyer. Initial consultation 250 EUR.

That was in October last year, right? According to the old thread, you were still looking for a company back then? What happened in those 3/4 of a year that now suddenly you want to get out? But? Additional construction costs are your issue, not the general contractor’s. The decisive influence on the additional construction costs is the lovely word "provided by the builder".

Go to a specialist lawyer and have the contract reviewed.
(It is usually easiest if your bank issues a letter stating that the financing (in the new amount) is not approved. But it depends on the contract)
