Terminate house construction contract? Wrong advice!?

That happens in 50% of the cases. There is objectively no reason for extraordinary termination. You can always terminate regularly, but then you have to compensate for the lost profit and you have no one to finish building your house. So it’s pointless. How far along are you with the construction? How big is the house and what is it supposed to cost? Don’t want any completely different surprises here.

I also don't see how the termination and the change could improve the situation. On the contrary, I see further costs accumulating and afterwards there will be problems with the warranty, etc. Of course, it was not nice of the [GU], but de facto it simply isn't his problem. As you say, you approached it too naively, the [GU] was just doing his job, that's how most do it in my opinion. Especially earthworks are the absolute classic for unplanned extra costs, that happens every day. Your problem is not the construction company, but the money.

First of all, take a deep breath. Without a soil survey, civil engineering is a gamble. There are always many "ifs and buts," which are reflected in conditional positions and billing based on measurements in offers. The general contractor miscalculated, which is frustrating. Termination seems unpragmatic – you want to have a house, right? How should things proceed after the termination without costs continuing to rise (rework)? Address the issue objectively and clearly. See what concessions you can get from the general contractor. Often, a business relationship is strengthened when a problem has been solved together. This will then also be reflected in the quality you receive from now on.

Sorry, but that’s exactly it... If we hadn’t had a soil survey done in advance, requested a quote from the civil engineer, and tried to find out all additional and sample costs in advance, it could have quickly added up to 50k more for us as well. I think it has increased by 10 anyway, partly for items that I didn’t have on the radar despite very careful research. To some extent, many here surely know that. I don’t think you can fight against it either.

sorry, the last few days were a lot of planning The problem was simply the consultation. The additional costs were just "wrongly" predicted despite doubts on our side. Then the boss of the GU said that in case of doubt he would contact a known civil engineer to do it at the stated price. Only that is currently the problem, apparently he suffers from dementia and cannot remember. That is actually what annoys me the most right now. The house has become a total of 10k more expensive because of things that could have been mentioned beforehand ( Frostschürze, Schneefang usw ). I just feel fooled by this bunch. They knew the maximum budget and now this.

Really crazy, I'm sorry. Unfortunately, you are now a negative example of building according to budget! Understandable that the builder does not want to bear additional costs
