Well. Freely selectable color is of course really very vague. In court, you would probably have little chance to enforce anything. Because freely selectable could also mean yellow or red as the exterior facade. And otherwise a surcharge of 10,000€ for all other colors. And freely selectable is the color with every general contractor. Namely for a surcharge. Therefore, it is not legally clear. On the contrary. But I also know that in rural areas agreements are followed and then sometimes additional sockets are not charged (if you think of it during construction), if both sides deal with each other fairly.

"Free choice" in the construction description of a consumer construction contract rather means that the general contractor has a poor hand. Consumer protection regularly does not interpret the vague wording of the more professional contracting party (in this case the general contractor) to their advantage.

Freely selectable simply means that you can have the house painted in colors according to personal taste. This does not involve a matter of price. Specifically, it should say: "is freely selectable without extra charge or free of charge".

Of course, that is regulated. I was talking about a construction service description. This is a concrete part of our contract for work. Such a construction service description specifically addresses the question "what is included in the price and what is not." If it says "color selectable," then while that is not particularly detailed, I believe an interpretation of "color selectable, but with an additional cost" would be legally difficult to enforce.
