Why is that? Because the staircase protrudes 10cm further into the hallway? What kind of defect is that supposed to be?

Nonsense, I say as well. The OP will have to live with that – no one will dismantle the staircase as it is disproportionate. Small money and that's it. Sorry, I don't think anything more can be done about it.

that's not a small defect  Every day the whole family passes by the stairs, the 10cm are simply missing, it will probably annoy for a long time. I would speak factually with the stair builder. If 10cm are built differently than agreed, hopefully he will understand and/or suggest a solution to change the construction. I see a proportionality here to the dismantling or modification of the construction. Ultimately, however, only the OP will be able to settle this with himself or with the contractor. An example: Would you accept a door with a height of 190cm instead of the ordered 200cm?

I cannot clearly recognize what exactly happened here – possibly a combination or cascade of incorrect construction (stairwell), incorrect measurement, and then incorrect construction (stairs) or correct construction and (possibly because the plan / actual situation was not checked beforehand) incorrect installation. Whether shifted linearly or completely off, I cannot tell clearly.

If built with an architect, I see a case for their professional liability; if DIY with a general contractor, the dispute could last longer than the entire construction period so far. Or was this even the classic own-goal combination "architect only commissioned up to the building permit, detailed planning is just for girls, and it probably didn’t go quite smoothly anyway"? – personally, I already only have red warning lights in my mental theater when I read "surface finish owner’s responsibility" in a plan...

Hello,
I would report this defect to the GÜ in writing.

I am surprised that the problem is only being discussed now (after [Estrich + Putz]). The issue of the too large staircase opening should have been addressed already during the measurement of the stairs. At the latest, it should have been noticed during the installation of the staircase frame.

Now I would talk to the parties involved and work out an amicable solution. See if any changes to the metal construction are still possible (in my opinion, this would be very complex).

If you can manage with the 0.95m space in front of the stairway, then possibly shifting/reducing the room door would be advisable so that you don’t run into the stairs daily when coming through the door!
