Real estate transfer tax / what is the tax applied to? Which developer MUST?

Of course, it's clear. If you answer question 1 with yes, that probably always means answering question 2 with yes as well, or how else should the house come about?
I am attaching a copy of the first page of the contract for work; you can see that it was after the notary appointment.
What is the purpose of the questions about the preliminary building permit and the building application? Is the building application submitted by the construction company in a linked transaction? That would be good, because in our case only we are listed as applicants.
For "Other," something like "The land seller and the construction company are not related; contracts were concluded independently of each other."
I also find the question about how one found the land great; I can't actually prove what I write there. Maybe I'm just too used to having to provide proof for everything...

There are plots for sale where either a preliminary building inquiry or directly a building application has already been submitted. So the buyer knows where they stand, what they are allowed to build.


Yes. Also describe how you found a) the plot and b) the provider.


Don’t make it so complicated; the tax office employees are also "ONLY" human ... they don’t bite, nor do they want to harm you

If there should be an economic connection between the plot seller and the provider, you will be noticed if your answer is wrong. If you stick to the truth and the tax office is missing information/proofs, they will ask you to submit evidence.

Is there any way to avoid the problem that I have to pay property transfer tax on the house if I sign the house contract beforehand?

We will sign over our plot of land from the municipality at the notary at the beginning of next year. Actually, everything was supposed to happen by autumn this year, but it has been delayed more and more.
In the meantime, of course, we have been busy and obtained offers and compared different house construction companies. This has now turned into a ready-to-sign contract with one company.
Since we want to secure the price and also apply for KFW by 12/12, we are now facing a dilemma.

We are practically being punished for having arranged planning in good time and for the notary appointment being delayed so long. And now we have to choose:
- KfW and secure the price and pay property tax on the house
or
- sign next year, possibly lose the KfW, pay a higher house price, but not pay property transfer tax on the house

This jurisdiction is not understandable to me...

Why do you have to pay for both?
To my understanding, these are two completely independent transactions, which are just close together in time for you, but do not involve any linkage. The property through the municipality had nothing to do with any GÜ / GU, right?
We signed the house construction contract shortly after the property notary appointment - no one ever asked,...
