That’s pretty funny, because our compost heap is in the corner on the border - doesn’t bother a soul. It doesn’t smell either - if yours stinks, you’re doing something wrong. And my sister is currently building her chicken coop directly on the border...
All I can say is, welcome to land ownership. Let me guess: is this your first own land?

Yes, terrace or no terrace, he can sit there. That doesn’t change the fact that he wants to sit exactly there. If it bothers you, you should have also bought the land.

If mere presence bothers you, he is not the disturber. Should he blindfold himself?

I am certainly the last one to advocate illegal construction. But for you, it’s not really about the terrace, but about the neighbor’s presence in his garden at that spot. That will probably remain your problem.

I am always surprised by the statement that the building authorities do not intervene...
A little anecdote: We built next to a footpath (the rear property boundary faces public land and there is a footpath there).
In the development plan it states (not as a planting RECOMMENDATION but mandatory!) what we are allowed to plant on this rear boundary. Beech hedge (red or hornbeam – at least we got to choose). Even without this clause, we would have chosen a red beech hedge because we like it. So all good.
Neighbors think beech is stupid, so they plant a mixed hedge. Someone from the building authority comes along and says: no no no... that doesn't work! So they now had to plant a beech hedge in front of it as well (there was enough space).
So, here it is checked what is being complied with and what is not!

By the way: the result next door now looks really sh.. oops: but that’s another story!

I have actually taken the general tenor to be that this is a new neighborhood, which, in the (un)favorable case, should last for decades, and that you should therefore think very carefully about alienating your neighbor right from the start by involving authorities instead of 1. talking, 2. looking for other solutions.

Yes I know......I hate people and just look for trouble...I got it.

If someone builds something disturbing and unauthorized on the shared border without properly informing the neighbor beforehand and does whatever they want.
The neighbor's opinion is therefore irrelevant and no consideration is taken.
Then I ask myself who is looking for or provoking the dispute?

That does not answer the question of what you intend to do now. Although—one possibility just occurred to me: simply continue to badmouth the neighbor here, maybe also a bit against the people who advise to do it better in the spirit of good neighborliness than your neighbor does... and continue to ignore all clear steps like reporting to the building authority or accepting.
