A boundary distance of at least 3.0 m must be maintained. This results from § 6 para. 5 of the Building Code of the Free State of Saxony. According to para. 1 sentence 1 of the Building Code, distance areas of above-ground buildings must be kept clear in front of the exterior walls of buildings. This also applies accordingly to installations from which effects similar to those of buildings emanate, in relation to buildings and property boundaries (sentence 2).

What exactly is subsumed under the term "installation" results from § 2 para. 1 of the Building Code. This includes, among other things, embankments (§ 2 para. 1 sentence 1 no. 1 Building Code).

If such an aforementioned effect emanates from the embankment, the necessary distance would have to be maintained.

This can only be assessed on site with the building authority.

Your neighbor has certainly piled up soil. This can be traced in the plan. Also, what happens if he ever builds a terrace roof?

The neighbor definitely built the terrace with a slope away from the house. So in case of heavy rain, the water flows directly onto your property. He is not allowed to do that. Therefore, there must even be a support at the boundary to ensure that the water stays on his property. At least a raised curb edge should have been on the terrace and a drainage channel.

By the way, this is also a reason why terraces as installations should not be built at the boundary distance. I am more than surprised at the last picture that one presents oneself so close to the neighbor.

Before this escalates, handle it professionally with the building authority. Your neighbor remains your neighbor. Do you want war even before you have moved in?

Ah... great... what is coming to light now.... I assume that he built it with a slope away, otherwise, in the worst case, he would have wet feet inside if water pools at the edge of the house.
