Non-compliance with the development plan by the neighbor

Such an "illegal construction," if it even is one, is always a tricky matter..

I just find it funny that the general tone here in the thread is that as a neighbor you should mind your own business and just spend money on it, even though the agreement is otherwise.

You can also safely forget about the building authority, because they don’t take any time at all for such a ridiculous matter.

Then when you create a thread asking whether you should risk carrying out such a construction without a permit, everyone screams from all sides that the building authority will kill you for it and the neighbor will be in conflict with you forever and might also take legal action, rightfully so.

Quite peculiar...

Yes, I also find that strange .... also the statement that it supposedly doesn't matter if everyone else doesn't comply with the development plan ...

Well, it would really piss me off if I always wanted a house with beige clinker, but the development plan says red ... I comply because I have no choice, when do you ever get a plot of land .... I make my house red ... and then the guy 3 houses down just comes along and makes it beige .... I think that's stupid

In our development area, someone simply used shiny tiles in blue, thought it looked nice ..... in blue .... okay, taste is subjective, but those dumb things blind you like crazy at 30 degrees roof pitch ..... why can't he just stick to the rules, it's not allowed .... am I then the bad guy as a neighbor because it bothers me in my living room and it causes him expenses because he has to remove it???

Or is he, because he doesn't follow the laws??

Crazy world that as a neighbor you end up being the troublemaker

I think if you've never been affected yourself, it's quite easy to just talk about it like that

"Your garden your problem" I don't think is bad either......
Then I build a compost heap right at the boundary......I don't care how you protect yourself from the stench...your garden.
Or you build a chicken coop and say....I don't care how you deal with the clucking....build a noise barrier.

Yes, if there was nothing there, you could also sit on the meadow. It's clear that you can sit wherever you want.
A terrace perhaps just offers minimally more for that? Because it is exactly for this purpose?

One should also show consideration for their surroundings somewhere.....and if you are already the "disturber," also immediately take measures so that you don't disturb at all.

And why should someone who has something "illegal" themselves snitch on their neighbors when they do the same/similar?
It would be clear that then action would be taken against themselves as well.....that way you serve your own ass on a silver platter.

This is because the people writing here try to impose their will on others. That almost always fails.
And why should we advise simply setting up a garden shed if it is not allowed? That also fails.
So what to do if there is no perfect solution?

Personally, I could go either way because I have the ability to admit defeat and then forget about it. But the people who complain here with their little problems, you know exactly that because of such trifles they will resent their neighbors for the next 30 years, be bitter every day, and blame everyone else. Of course, I advise these people against any risk. Because the risk is that the garden shed has to be removed by the river, but the terrace may stay. Forcing the neighbor to fence in? Great idea, then you get a chain-link fence or something similar. It just doesn’t work to impose something on others if they don’t want it.

Kinkerlitzchen for me is when the hedge is 5cm on my property or when a branch is hanging over somewhere. I am by no means picky and preferably measure everything down to the exact cm to see if everything is really correct.

But that is already a more serious intrusion on my quality of living, which theo. is not allowed. And that makes me angry.

"Everyone else is supposed to be to blame".......actually just one...,..even other neighbors ask me why he builds something like that on the boundary or if he is allowed to......I didn’t build it or sign anywhere that I agree.....and I’m not the only one wondering what that’s supposed to be. Therefore, I could get really pissed off about something like that. Should one be happy about that?

If I discuss things properly....the neighbor agrees and signs for it...then everything is fine.

But in my opinion, this is just disgusting.

Yeah, then go to the building authority if you don't want to go to the neighbor. I can't think of any more options (except accepting it/putting up something as a privacy screen yourself, which you don't want to do either). Ok, also illegal things like setting fire to the terrace at night, but we don't want to suggest crimes here...
