that is basically correct, once it becomes formal, there is no way around a building rights lawyer. Currently, the OP is not legally affected at all, since the neighbor’s objection has so far had no consequences. The OP did the only right thing by informing a lawyer in advance and getting advice, that saves time in case of emergency and one is much better prepared for the dispute "at the garden fence."

Nevertheless... I would take a very close look at the boundary construction issue. And having a plan B never hurts. Especially if it is supposed to be a prefabricated house, costs for the builder quickly arise from delays due to the tight scheduling of the manufacturers. The sooner you prepare something in advance or have a plan B, the better. What I wouldn’t wait for, however, is whether such nonsense will be settled by the highest court in a few years. Then again, the lawyer’s assessment is needed on how high the risk of a construction stop or redesign is.

I can't address everything right now because I am home alone with all the children. However, I have scanned our site plan. Unfortunately, this is not the most current one. Due to the trees on the right-hand side, we had to rotate the house and keep a distance of 5 meters from the trees, so our carport is now almost directly next to the neighbor's parking space. The neighbor's parking space is not marked but is located directly to the right of the house up to / on the property boundary. Unfortunately, I just don't know the correct wording for this; I probably mean the same thing when I write "on" and you write "to" the property boundary. Our house, however, has a distance of more than 3 meters from the neighbor's parking space. Best regards, Nicole

So... that already helps a little, but the most important thing would be the most current plan.

What I see at first glance: Your clearance area extends into the neighboring property -> from this, there would have been a claim for compensation payment to the neighbor.
If your carport is now located to the right, someone with exact knowledge of the Thuringian building code would need to say to what extent this can be constructed as a privileged project within the clearance area.

And the trees on the right are no longer present today, but were they protected stock? Then immediately document the actual condition in a legally secure manner!
