Very interesting! Had the same problem! We were only allowed 1 meter high, in the end we ended up at 1.20. 20 cm that the neighbor agreed to. Sloping would have meant that it would never have been properly mowed here.

Hmm, so property legal protection and neighbor disputes are covered. I might have to inquire about that.

That is and was not our goal. But we will defend ourselves if necessary – after all, you don’t have to put up with everything.

It is always a double-edged sword. After we found out that the neighbor had set the retaining wall incorrectly contrary to legal requirements (the slope was made on our property = estimated loss of property value 1-2,000 euros), we asked him to at least build the wall up to the maximum permissible height so that the loss in value for us would not be so great. The neighbor refused to do this. Of course, we could have also tried in court to have the neighbor tear down the wall again (value of the entire wall according to statement about 11,000 euros). But how the judge would decide is uncertain (trivial matter, settlement, or similar)? In the case of a settlement or dismissal of the lawsuit, we would be stuck with our share of the costs. To avoid escalating the dispute (after all, you live next to each other for many years), we reluctantly accepted the incorrectly erected wall and accepted the financial loss. Nevertheless, we are "cut off" by this neighbor as well as by a neighbor across from us (the two have become friends). With the neighbor across the way, we can only suspect that the situation was misrepresented and that we are "troublemakers" to him. Fortunately, we get along well with the other neighbors in the area. You have to assess for yourself how far you want to go. At the beginning, the conversation should be sought. In my opinion, the building law situation should also be addressed there. I regularly get annoyed about the loss of value of the property. But I console myself every time by the fact that we are not sitting in a bunker .

The question is whether a loss in value/additional expense of 1-2 thousand € is sufficient here.

As a layman's solution, I see 3 possibilities without depending on the neighbor: Either the house including the parking space has to be set lower, which leads to a slope towards the street, or you leave the house as it is but have a driveway that first has to overcome a height difference of 2m and you essentially park at basement level, or the parking spaces have to be created elsewhere, which presumably means a completely different location of the house and possibly involves replanning. None of this is really attractive and, if at all feasible, is associated with many additional costs.

If it is really the case that the neighbor is already threatening with a lawyer over a wall that even the original poster would have paid for and that it may even be legally clear that the neighbor would potentially have to bring his property boundary up to street level, then I would have it enforced by a lawyer if necessary. The relationship seems to be broken anyway at the moment.


The worst thing is that the relationship with the neighbor is still broken, even though you gave up and you regularly get annoyed when you see the property boundary. And it was only about 1-2K€.
