We have submitted a building application. The full designation is "Building application according to § 68 Saxon Building Code (SächsBO). The box for 'Simplified building approval procedure according to § 63 SächsBO' is checked. I have tried to read into the Saxon Building Code, but as a non-lawyer I don’t understand much. Well, in the worst case I will have to have it all "translated" by a lawyer. My only problem is, if the house construction is stopped halfway, my husband and I will be responsible and not the lawyer, the employee of the building authority, or the construction company. The revised construction documents (the architect called them "tektures") were submitted on 18.04.21.

- In the first letter from the building authority titled "Request for documents" dated 22.12.2020, it was pointed out that "...the processing period of the building supervisory authority begins only with the confirmed receipt date of the complete documents according to § 69 paragraph 2 sentence 1 SächsBO (§ 69 paragraph 4 SächsBO)." The missing documents were subsequently submitted on 29.01.2021.
- In the second letter from the building authority titled "Confirmation of completeness of the construction documents" dated 03.02.2021, completeness was confirmed as of 01.02.2021. This letter refers to § 69 paragraph 4 SächsBO "in the presence of an important reason."
- In the third letter from the building authority dated 24.03.2021 labeled "Hearing according to § 28 Administrative Procedures Act (VwVfG)," we were informed that "the consent of the city ..." was not granted.
- In response, on 31.03.2021 we submitted an "application to suspend the procedure for 3 months" in order to revise the construction documents and adjust them to the requirements of the development plan.
- In the fourth and final letter from the building authority dated 08.04.2021 titled "Confirmation of suspension of the procedure," it was stated that "The deadline running as of 01.05.2021 according to § 69 paragraph 4 SächsBO" was suspended.
- On 16.04.2021 we submitted the revised documents and received no further written communication. Only last week, following my phone call, was I informed by phone that yes, we can build, and was pointed out that no further written approval would be issued, but I could apply for a "certificate for the so-called approval fiction according to §69 paragraph 5 SächsBO." I have done so and hope that such a certificate is not too complicated to issue.

The authority staff really work very well, competently, and quickly despite difficult conditions (Corona, illness, vacation), and I do not want to bother them unnecessarily, but without something in writing in hand, my husband and I do not dare to build.
