What I would do in your place:

    [*
      call again - either you get the same person and probably the same answer, then note down the name. If you have someone else on the phone, ask for a written confirmation without mentioning the first call.
      [*]If you do not receive anything in writing, but do receive the statement that you are allowed to build, write a letter to the person who gave the information and to the head of the building authority. The letter must include:
      [LIST=1]
      [*]date, time of the phone call, contact person
      [*]exact wording of your questions and the answers in indirect speech, e.g. I asked Ms. Dingenskirchen whether we were now allowed to build. Ms. Dingenskirchen said that we were allowed to build and that no further written form was required by the building authority. I followed up and asked whether it was okay to start the work in KX xy. Ms. Dingenskirchen confirmed that with a yes.

    [*]Now wait 2 weeks to see if your letter is contradicted. If not, you have created a file situation which is not completely legally secure but puts you in an excellent position. With this file situation, I would start construction.

The technique is also called confirmation letter - very effective in many situations. :-)

I will do that. Today I will call again and on Monday I will then, if necessary, send a letter via DHL. The situation is very frustrating right now. I had prepared myself for possible difficulties with materials, craftsmen, etc. in connection with the house construction. That obtaining written approval for a house despite an existing development plan and, in a second step, precisely observed requirements would be so complicated, I did not have on my radar. Well, we have made mistakes in bureaucratic matters due to our ignorance in that regard. Unfortunately, any price guarantees we negotiated when purchasing the house have probably also expired by now.

I am also worried that if it drags on any longer, from September we might have a green government or a government with green participation that further delays the construction of our house or even makes it impossible through new regulations; I have already calculated how much it would cost us if we ultimately cannot build the house. It won’t ruin us completely at least. But now I try to stay optimistic and hope that we receive the aforementioned confirmation soon. :)

I have to ask again here.
For all correspondence, don't you always include copies of letters with the (building) documents!?

And the offices already have email nowadays as well. :D

I have all letters either in paper form or as messages on the computer. Are you referring to specific letters? At the moment, I don't understand what you are getting at. ;-) I have not received any written notification that we are allowed to build.


That's correct. I have already sent emails as well. However, the application for the aforementioned certificate is not accepted by email; the application must be submitted by letter, which I did last week. Unfortunately, not via DHL with proof of delivery, which I will make up for on Monday.
I am still trying not to annoy the government officials too much because I am afraid they might then not help me at all. My husband keeps telling me that I am basically way too friendly and nice; ;-) I should say what I want "quick and straightforward" and not say "Could you perhaps kindly, if it’s no trouble, at your convenience…". ;-)

That is a very good and commendable idea.

No, as long as it’s nothing religious.

I deal a lot with authorities, so my sympathy is limited.

But this concern is very far-fetched. First, "The Greens" do not want to make building impossible; second, it is about the Bundestag, which only passes federal laws that at most affect future land-use planning; and third, legislative changes, unless they involve global emergencies, take a lot of time.

That is somewhat conciliatory after all.

Yes, gladly, show me. Are there also references to the legal bases (on the back or something...)?
