The tough counter-question is how many legal instances you can finance for a construction site. In that context, laying the insulation boards over the base slab might be the lesser evil (if indeed only thermal insulation and not also moisture insulation was omitted). In my opinion, a height adjustment before the basement ceiling goes on makes sense. The building permit would, in my opinion, have to be adapted to the new construction; I have no idea what KfW consequences that might have.

However, I can also well align with the viewpoint

Isn't some things getting mixed up here? How can insulation on any ceiling help against forgotten insulation under the floor slab? Besides, he doesn't have a basement.

Where is the construction now? Can the ground floor walls still be raised?

You can also create the insulation "downwards" through an insulating layer between the slab and the screed. I would, however, completely disregard Tomtom's comment. The thermal insulation certificate is part of the building permit. I consider it very dangerous to dismiss it in such a way.

But that does not mean that it is absolutely necessary. You have to look at the whole thing and decide if it is worth it to you.

Functionally, you do not have to insulate under the base plate in a modern building energy saving ordinance house.
Before it comes to a huge argument and you are the loser, take the money they offer you.

Furthermore: Hide. Too generalizing, the overall concept counts. If the base plate was planned with insulation, then there is a reason for it. Omitting it is possible, yes, but then has consequences for measures elsewhere.
