The ceiling is, "fortunately," now 7 weeks behind schedule - so the construction company could still add another layer.
That means, so far only the basement walls are standing? - in that case, demolition wouldn't be half as tragic. However, I would rather involve a specialist lawyer than a construction expert, since I would immediately consider changing the contractor (who knows what else they might forget).
The tough counter-question is how many legal instances you can finance for a construction site. In that context, laying the insulation boards over the base slab might be the lesser evil (if indeed only thermal insulation and not also moisture insulation was omitted). In my opinion, a height adjustment before the basement ceiling goes on makes sense. The building permit would, in my opinion, have to be adapted to the new construction; I have no idea what KfW consequences that might have.
